How can my account be hacked when i havent played it in years?

Blizzard says that all is fine, don't you believe them?
And yes that probably is a phishing email and could be phished from your battlenet email address. If you can go to either their technical or customer support forum there is a thread listing all the submitted phishing emails that people have forwarded to them.
I wouldn't be surprised if Blizz sold everyone's email addresses for profit and somehow the hackers all got the lists. Or they just mass spam all yahoo and gmail accounts, hoping to get hits.
I agree. I have recived many emails like this and others from them saying that Im in the cata beta as well. There all bs and yes Blizz needs to get off there arses and do somthing about this.

they mostly seem to be using hotmail to send the scam mails fortunly I have SPF enabled and blizzard publishes a SPF record so a ton of stuff is getting marked as spam and dev nulled
